Factors determining the duration of forced medical treatment
I would like to investigate whether the severity of the crime committed by psychiatric patients who are subject to involuntary medical treatment in Hungary, the identity of the victim, the degree of injury, the social background of the patients, or possibly other factors influence the duration of involuntary medical treatment.
Currently, 240 patients undergoing compulsory medical treatment are being treated at the institute. Detainees come from all over the country, whose admission and treatment must be taken care of. In recent years, the lack of space and the overload of the institute have become an increasingly common problem. That is why it has become an increasingly important issue to reduce the number of forced medical treatments and the number of patients treated with forced medical treatment, which is the only way to increase the number of terminated forced medical treatments.
Conditions for ordering forced medical treatment
Criminal is deemed to be clinically insane
Violent crime against a person or causing public danger
Penalty minimum 1 year (if punishable)
Risk of recidivism
Conditions for termination of forced medical treatment
Permanently compensated condition
Protective background (family or social institution)
Elimination of the risk of reoffending
Dilemma
Does the seriousness of the crime affect the duration of compulsory medical treatment?
The patient's condition affects during the treatment?
Is forced medical treatment sustainable due to the lack of a protective background? Compulsory medical treatment is ordered by the court for an indefinite period of time and its necessity is reviewed every six months with the involvement of an independent psychiatric expert. It may happen that the offender will undergo medical treatment for a longer period of time than he would serve the prison sentence for the same act.
Method of the research
I plan to examine the research with retrospective data processing, using the quantitative, quantitative method from the medical, legal and reintegration materials of the institute, using the documents of the past twenty years.
Aims
Development of a proposal to identify objective health and social variables that can be used to determine the duration of forced medical treatment.
